The Law

Spanish law states builders and developers receiving deposits had to put the money in a separate account and provide a bank guarantee.

This would ensure money was returned if the developer failed to finish building a property.

However, this law was not always observed and when the property crash hit in 2008, developers had not set aside enough cash to repay customers.

Supreme court ruling

On 21 December 2015, the Spanish Supreme court issued a landmark judgment that the property developer’s bank is responsible for missing money deposited in their accounts.

These cases are complex and you can only submit a claim through the courts once.
